The placing of an order by a Customer constitutes acceptance of the terms and conditions set out below.
All prices are subject to alteration, all orders are accepted for execution at the prices ruling at the date of dispatch unless otherwise agreed in writing.
Payment terms are strictly COD until such time as account facilities have been granted.
All account applications will require the clearance of Kreditinform and are granted subject their approval. Ataraxia Wines or their designated representatives may stop purchases on credit and place an account on a C.O.D. basis at its discretion.
Ataraxia Wines shall be entitled, but not obliged to institute any legal proceedings against the customer in any Magistrates Court having jurisdiction over it, even though the cause of action is beyond the jurisdiction of the court.
The customer shall be liable for all legal costs as between Attorney and Client as well as collection commission should it be necessary for legal action to be taken for the recovery of any amounts owing arising out of purchases made.
The customer and any surety appoints the address referred to on the application form as his / her Domicilium Citande et Executandi for all purposed relating to this agreement.
Goods supplied remain the property of Ataraxia Wines until paid for in full.
Accounts are due for payment 30 days from date of statement, namely by the 30th of each month, unless otherwise agreed to in writing.
If any amount owing by a customer is unpaid on due date, then all other amounts owing by the customer to Ataraxia Wines, whether due and payable or not, shall become due and payable forthwith.
Special delivery charges may be levied where geographical or commercial reasons so require.
Ataraxia Wines reserves the right to charge interest on overdue accounts at the bank over draft rate plus 2%.
All goods should be examined at the time of delivery. Any loss or damage should be signed for accordingly. Claims cannot be recognized after a clear receipt has been issued.
Goods sent by rail or carrier other than those appointed by Ataraxia Wines are at the risk of the purchaser.
Goods may only be returned for credit after prior consent of Ataraxia Wines management or their appointed representatives. A 10% handling fee will be levied.
All goods are offered subject to availability at time of order.
All customers are required by law to furnish Ataraxia Wines with a valid copy of their Liquor License and VAT No.
